These terms apply to vendors participating in East Austin Market events. Please review them before submitting your Vendor Application.

By submitting an application and payment to participate in East Austin Market (“EAM”), Vendor agrees to the following:
Application & Acceptance
Submission of an application and payment does not guarantee acceptance. Applications are reviewed individually based on the needs and mix of each market. If Vendor is not accepted, the application payment will be refunded.
Market Policies
Vendor agrees to comply with the current East Austin Market Vendor FAQ, market-specific instructions, venue requirements, and all load-in, setup, operating, parking, and load-out instructions provided by EAM.
Booth & Display
Booth placement is determined by EAM. Vendor must remain within the space allocated and may not obstruct neighboring booths, walkways, entrances, exits, or other required access areas. EAM may require Vendor to modify a setup that creates a safety or operational concern or does not comply with market requirements.
Equipment & Power
Vendor is responsible for tables, chairs, displays, merchandise, equipment, and other setup materials unless expressly stated otherwise. Outside canopies are not permitted unless specifically authorized by EAM for a particular event. Venue power is not provided, and gas generators are not permitted.
Attendance, Cancellations & Weather
Vendor may not dismantle or leave the market before the scheduled closing time without EAM authorization. Vendor cancellations and no-shows are non-refundable. Vendors unable to attend should notify EAM at least 24 hours in advance. If EAM holds the market as scheduled, weather-related Vendor cancellations are non-refundable. Postponements, rescheduled events, and related credits will be handled according to the current Vendor FAQ.
Licenses, Permits, Taxes & Insurance
Vendor is solely responsible for obtaining and maintaining all licenses, permits, registrations, certifications, insurance, and governmental approvals required for Vendor's business, products, services, and participation. Vendor is solely responsible for collecting, reporting, and remitting applicable taxes and maintaining any required Texas Sales and Use Tax Permit or applicable exemption documentation.
Products & Services
Vendor is solely responsible for the legality, safety, quality, labeling, preparation, display, sale, and use of Vendor's products and services. Vendor may only offer products or services consistent with the application approved by EAM unless otherwise authorized.
Food, Beverage & Alcohol
Where food or beverage vending is permitted, Vendor is responsible for satisfying all applicable venue, health, safety, licensing, permitting, and governmental requirements. Alcohol may not be sold, served, distributed, or brought for sale or distribution unless expressly authorized by EAM and the venue and permitted by applicable law.
Property & Conduct
Vendor assumes responsibility for Vendor's merchandise, equipment, displays, vehicles, and personal property. EAM and participating venues are not responsible for loss, theft, or damage to Vendor property except to the extent liability cannot legally be excluded. Vendor is responsible for the conduct of Vendor's owners, employees, contractors, representatives, and guests and for damage caused by Vendor's operations, personnel, equipment, products, or activities.
Indemnification
TO THE FULLEST EXTENT PERMITTED BY LAW, VENDOR AGREES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS EAST AUSTIN MARKET, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES, AND THE APPLICABLE PARTICIPATING VENUE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES, FROM AND AGAINST CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS' FEES, ARISING OUT OF OR RELATING TO VENDOR'S PRODUCTS OR SERVICES, BOOTH OR BUSINESS OPERATIONS, ACTS OR OMISSIONS, PERSONNEL OR REPRESENTATIVES, PROPERTY DAMAGE CAUSED BY VENDOR, OR VENDOR'S VIOLATION OF THESE TERMS OR APPLICABLE LAW.
Photography & Promotion
Vendor grants EAM permission to photograph or record Vendor's booth, products, displays, and representatives during the event and to use those images or recordings for EAM's website, social media, editorial, advertising, and promotional purposes without additional compensation.
Event Changes & Compliance
EAM may make reasonable changes to booth placement, event layout, schedules, operating procedures, or other event logistics when necessary for safety, venue requirements, weather, operations, or the overall market. EAM may require Vendor to modify or discontinue conduct, products, displays, or activities that violate these Terms, market policies, venue requirements, applicable law, or create a safety or operational concern.
Acknowledgment
By submitting a Vendor Application and checking the required acknowledgment during checkout, Vendor confirms that Vendor has read, understands, and agrees to these Vendor Terms & Conditions.
